The following Terms & Conditions must be accepted by the “Hirer” prior to Mini Munchkins Party Hire making the goods or services available to the “Hirer”

Definitions
​
Equipment means all property including, all props, serve ware, costumes, furniture, displays, backdrops and any items listed on website which Mini Munchkins Party Hire agrees to hire to the Hirer.
The “hirer” means the person(s), hiring the equipment and entering into a contract with Mini Munchkins Party Hire will be referred to as the “hirer”.

Terms and Conditions

Introduction- These are the terms and conditions of Mini Munchkins Party Hire (Mini Munchkins Party) ABN 74 455 623 651
​
Application- These terms apply to all Equipment hired by the Hirer from Mini Munchkins Party Hire.
​
The hirer enters into a contract and agrees and accepts the Terms and Conditions from the date they inquiry about a booking with the supplier.
The equipment remains the property of Supplier at all times. The hirer may not this contract to another party without written consent of Supplier.
The supplier reserves the right to change the prices/specials on the site at any time.

Offer and Acceptance- The Hirer may offer to hire the Equipment via Mini Munchkins Party Hire website. The Hirer will receive from Mini Munchkins Party Hire an email quotation that is valid for fourteen (14) days from the date of the quotation. The Hirer may accept the quotation by responding to the email and paying a deposit in accordance with clause below. Mini Munchkins Party Hire reserves the right to alter or decline a quotation after the expiry of fourteen (14) days. All orders are subject to availability.

Proofing- Mini Munchkins Party Hire will take all reasonable steps to ensure an order is accurate and correct, however it is the responsibility of the Hirer to ensure all items, and quantities listed on the quote/ invoice are correct. The Hirer must notify Mini Munchkins Party Hire of any faults or missing items within 2 hours of receiving the equipment for hire.

The hirer must inspect and check all equipment and notify Mini Munchkins Party hire at the time of collection if there is any equipment missing, damaged or unfit for use. Failure to do so will see the hirer responsible for any damages or missing equipment upon pick up.
​
Security Bond - A security bond is applicable on all items hired from Mini Munchkins Party Hire. A security bond of $100 is required to be paid in respect of all bookings. This bond will be returned to the Hirer when the Equipment is returned to Mini Munchkins Party Hire in the same original condition as it was when the Hirer first took possession. Items returned early are not eligible for a refund for unused time.

This bond is paid in addition to any replacement costs for any damaged or lost Equipment. You must supply your bank account details to Mini Munchkins Party Hire so the bond can be returned to you in a timely manner.
​
Payment - The Hirer must pay a non-refundable 25% deposit within seven (7) days of receiving a tax invoice from Mini Munchkins Party Hire to confirm its booking, failing which the Equipment will be made available for hire by others. Payment of the balance is due seven (7) days prior to the event. Payment can be made by direct deposit to a bank account nominated by Mini Munchkins Party Hire (the details of which are listed on the invoice) or by credit card. Equipment will not be released to the Hirer until Mini Munchkins Party Hire has received payment of the invoice in full.

Credit Card Payments- All credit card payments are subject to a 1.75% merchant fee.

Hire Period - If the Hirer collects and returns the Equipment, the hire period is 24 hours. If Mini Munchkins Party Hire delivers and collects the Equipment, the hire period is 12 hours, unless otherwise discussed and agreed.

Collection and Return - Equipment can be picked up on the Thursday or Friday before the Hirer’s event and returned to Mini Munchkins Party Hire on the following day. Equipment can be collected from and returned to: Kallista, or Mount Evelyn (Arrange prior to collection and drop off)

Delivery and Pick Up. – Mini Munchkins Party Hire’s aim to keep the cost down that is why it is mainly a DIY set up. However, if requested, for an additional cost, Mini Munchkins Party Hire will deliver Equipment where the cost of the hire booking is over $400. Delivery and associated labor costs vary depending on various factors including delivery to and removal from higher or lower levels other than street level, presence of stairs or steep inclines. At the time of booking, Hirer must inform Mini Munchkins Party Hire of such obstacles.

Hirer must ensure that Equipment is packed down and ready for collection by Mini Munchkins Party Hire otherwise late fees will apply.

The hirer assumes proper knowledge in the operation and handling of the equipment and follows OH&S policies and does not hold Mini Munchkins Party Hire responsible for any injury caused to themselves or others whilst moving or setting up any equipment.
​
Late Returns - The Hirer must pay the following to Mini Munchkins Party Hire for all Equipment returned after the return date (as outlined in the invoice): A daily fee of $40 for each and every day (or part thereof) late until delivered back to Mini Munchkins Party Hire.
​
Dangerous Conditions - In the event of severe inclement weather such as torrential rains, strong winds, flooding and extreme thunderstorms, Mini Munchkins Party Hire reserves the right to withhold Equipment (either in whole or in part) if there is risk of the Equipment being damaged or a hazard to any person, property, animal or thing. Mini Munchkins Party Hire will substitute the Equipment with something more suitable to the elements, if possible.
Hirer Responsibilities - The hirer is liable for the replacement cost of any equipment that is stolen, goes missing, is vandalised or broken. The hirer is liable for any damages caused to the equipment, and this includes damages caused by weather and vandalism. In the event that equipment is heavily dirtied during the hire, we reserve the right to charge a cleaning fee to clean the equipment.

In addition to other responsibilities set out elsewhere in these terms, the Hirer agrees to:

maintain and return the Equipment in the same condition as it was when the Hirer first took possession;

return all packing materials and boxes that were given to the Hirer upon collection;

be responsible for all damage to Equipment, howsoever caused, whilst in the Hirer’s possession;

promptly pay all charges in accordance with these terms;

promptly return all Equipment (including any associated boxes and packaging) to Mini Munchkins Party Hire at the end of the hire period, without the need for Mini Munchkins Party Hire to demand the same

pay all expenses, costs or disbursements (including legal costs) incurred by Mini Munchkins Party Hire in recovering any outstanding monies due under these terms; and provide Mini Munchkins Party Hire with their credit card number, expiry date and any other information that may be required to debit the Hirer’s credit card for any late returns and damages or loss fees post the event. The Hirer hereby authorises Mini Munchkins Party Hire to debit the Hirer’s credit card with the amount shown on all outstanding invoices if the Hirer has not paid that amount within seven (7) days post the event.

The Hirer will maintain the equipment in good condition and if the equipment is returned soiled, sandy, smelling of cigarette or other smoke scent or stained, or containing any bodily or other fluid including blood, urine, faeces or other you will be charged a cleaning fee and will be deducted automatically from your bond. Mini Munchkins Party Hire does not accept responsibility for any injury to person or persons or damage to property belonging to you or to anyone else, which arises from the use of any equipment hereby hired. If the hirer is a consumer, nothing in these Conditions restricts, limits or modifies the hirer’s rights or remedies as against us for failure of a statutory guarantee under the Australian Consumer Law.

Indemnity - The Hirer indemnifies Mini Munchkins Party Hire against all claims Mini Munchkins Party Hire may incur as a result of the Hirer’s negligence or breach of these terms.
Liability – Mini Munchkins Party Hire takes all reasonable steps to fulfil orders but is not liable to the Hirer should any of the following occur.

Failure to deliver or delay in delivery/collection, for any reason.

Failure to have the Equipment ready for collection by the Hirer when the Hire Period begins.

Loss, damage or injury to any person, property, animal or thing arising from the possession, operation, collection, installation, use, dismantling and delivery of the Equipment during the hire period, which is from collection time to return time.

The displays chairs and highchairs are not suitable for baby, toddler, children to seat and eat unattended at anytime. Do not leave child unattended. These are props are should be used under parental supervision. The high chairs are Ideal for decorative use only and does not meet the criteria for highchair standards in Australia. We are not liable for any accidents or incidents, resulting to injury that may occur when the child sits in the highchairs. They are Props only.

The hirer must keep itself acquainted with the state and condition of the Equipment and ensure that it remains in a safe, serviceable and clean condition. Any breakdown or any unsatisfactory working of the Equipment must be immediately notified to us. Under no circumstances shall the hirer repair or attempt to repair the Equipment. If requested by us, any Equipment, which the hirer claims requires repairs, must be returned to our premises by the hirer for examination.

Damage & Loss- The Hirer is responsible for any damage or loss to any of the Equipment that arises during the time from when the Hirer takes delivery of the Equipment until the Hirer returns the Equipment to Mini Munchkins Party Hire. If the hire item/s is not, lost or considered by Mini Munchkins Party Hire to be irreparably damaged, in which case the Hirer must pay full retail value/cost to remake/rrp list price of a brand new replacement item. Within seven (7) days of such damage or loss coming to the attention of Mini Munchkins Party Hire and being notified to the Hirer.

Cancellations- Cancellation fees are subject to the following schedule:

Bookings cancelled within 3 days period from the event data incur a 100% cancellation fee

Cancelled bookings outside of 3 day period from the event date incur a non-refundable charge of 50%.

Cancelled bookings as a result of Covid 19, extreme restrictions and weather conditions still apply.

Photography. The Hirer permits Mini Munchkins Party Hire to use any photograph of the Equipment on-site for business and marketing use. We welcome reviews and photos to be sent to Mini Munchkins Party Hire.
​
Digital Graphic Design Work -. Hirer must approve proofs for custom graphic design work. Mini Munchkins Party Hire is not liable for errors post-approval. Cancellation forfeits 100% of the order cost.
​
Editable Digital products are non refundable of any kind due to their nature.
​
Copyright -The Hirer acknowledges Mini Munchkins Party Hire's copyright in designs and materials produced, and agrees not to infringe on it.
​
Governing Law. These terms are governed by and construed in accordance with the laws of Victoria.

Privacy Policy All personal information collected by Mini Munchkins Party Hire is protected by the Privacy Act 1988 (Commonwealth of Australia). Any and all information collected at this website – including application form content and email addresses – will be kept strictly confidential and will not be sold, re-used, rented, loaned or otherwise disclosed to a third party, except where prior written permission is obtained from the individual who supplied the information and to whom the information refers. No attempt will be made to identify users of their browsing activities except, in the unlikely event of an investigation, where a law enforcement agency may exercise a warrant to inspect the service provider’s logs. Any personal information provided to Mini Munchkins Party Hire by site users will be treated with the utmost care, and will not knowingly be used in ways not explicitly consented to by the user who supplied the information and to whom the information refers.
